These changes have increased the attractiveness of pension planning by individuals. At the same time the tax relief restriction on annual pension contributions continues to be under the spotlight. This combined with continuing reductions in the Lifetime Allowance puts constraints on tax efficiency and can result in tax charges. In addition the new state pension arrangements are due to come into operation from April 2016. HMRC also seek to enforce the correct tax treatment, perhaps even more rigidly than previously, and the penalties for incorrect treatment can be significant. As well as setting out disclosure requirements, the Companies Act 2006 set out the legal restrictions regarding transactions with directors, in particular setting out instances when shareholder permission is needed. CONTENT • Companies Act 2006 – legality of transactions and possible consequences • Companies Act 2006 – disclosure requirements for advances, credits and guarantees together with the changes for small companies now that abbreviated accounts can no longer be filed. • FRS 102 – accounting treatment of loans to and from directors whether at a market rate of interest or representing a financial transaction • FRS 102 – disclosure of transactions and the changes from FRS 8 and the FRSSE • Scenarios including – Benefits in kind; Directors’ current accounts; Amounts drawn in advance of remuneration; NIC and PAYE implications This course contains little formal lecturing as the focus will be on the case studies. This course will use a series of case studies to revise the relevant principles. The object will be to take a number of transactions involving directors and consider in detail the legal and tax consequences and the disclosure requirements.
