2012 Interim Ressponse Actiivity Plan D Designed to Meet Criteria Work Plan (Work Plaan) (URS, 2012) approoved by thhe Michigann Departmennt of Environm mental Quality (MDEQ)) on June 1, 2012, Thee Dow Chem mical Company (Dow), with oversightt from the MDEQ, haas completeed the implementationn of Year 1 (2012) of the presumpttive remedy y for the Citty of Midlan nd area soills. This 20113 Work Pllan and Adaaptive Managem ment Reportt documents the presum mptive remeddy implemenntation planns for the seecond year of im mplementatiion (2013) and a presents a review annd evaluatioon of 2012 ddata to inform m the plans forr 2013. Thee purpose off this 2013 Work Plan and Adaptivve Managem ment Report is to provide the t following g: 2013 Overvieew; Properties ideentified for sampling s in 2013 2 (Phasees I, II, and 22014 Phase II); Recommend R updates to the t Work Pllan, if warraanted, basedd on the resuults of 20122 data ev valuation; Data D Evaluatiion of the results from 2012; and Planned activ vities for Lan nd Use Moniitoring. 1 The D Dow Chemicall Company – M Michigan Operrations 20113 Work Plan aand Adaptive M Management R Report 2.0 Project P Impllementation n for 2013 The seco ond year of im mplementatiion focuses on o the next ggrouping of properties thhat are withiin the closest distance d from m the Mich higan Operattions facilityy within thee Midland R Resolution A Area. 2013 imp plementation n will occur in three phasses: Phase I ( sam mpling began in Fall 2012 2); Phase II (plan nned for Spring 2013); and a 2014 Phase I (sampling planned p for Fall F 2013). Each of these phases is depicted d on Figures 2-1 througgh 2-3. Thee recommenndations from m the nt evaluation ns presented d in Sectionn 3 will not be used forr the review w and adaptive managemen evaluatio on of 2013 Phase P I propeerties as the work has allready been completed. The 2013 P Phase II (Sprin ng 2013) an nd 2014 Phaase I (Fall 2013) propeerty program m will folloow the propposed recommeendations up pon approvall of the plan by the MDE EQ. The folllowing secttions describbe the objectivees of the 201 13 implemen ntation efforrts and provvide details oon each of tthe phases oof the 2013 imp plementation n plan. 2.1 Objectives O fo or 2013 The follo owing objecttives guided the development of the 2013 work pplan: Areas A most liikely to need d remedy aree prioritized; All A remedies are compleeted during the t same season as wheen owner is notified off their reesult; The T time betw ween remedy y decision an nd remedy ccompletion iss minimizedd; and As A remedy can c only be effectively completed dduring the cconstructionn season, baccklog must m be manaaged to prevent down (orr “lost”) tim me. 2.2 2013 Phase I 2013 Phaase I implem mentation beg gan in Octob ber 2012. T These effortss were propoosed to MDE EQ in a letter su ubmitted viaa email on September S 6, 2012. The prooposed proppertyspecific sampling s inccrement map ps for 2013 Phase I werre submittedd at the time of the requeest to begin this phase in 20 012. These maps will not be resubm mitted as parrt of this repoort. A numbber of nt locations were w manuallly adjusted in response to both fieldd conditionss during sam mpling incremen and MDE EQ review. The finalizzed maps will be providded in the 22013 Implem mentation Annnual Report. 2013 Phaase I encom mpasses the areas descriibed below, including a total of 3118 propertiess and encompaassing an areea of approx ximately 87.2 2 acres of prroperty that is in residential (70.8 aacres) or residen ntial-like (1..9 acres) usee. Roughly 14.5 1 acres inn this area arre in non-residential use.. The aerial exttent of the 2013 2 Phase I implementaation area too the north aand northwesst of the Middland Facility is: i Bound B to the north by Un nion St., Norrth St., Arbur ury St., and F Fournie St. Bound B to the west by Rod dd St. and Sttate St. Bound B to the east by Eastt Patrick St., State St., annd Bayliss S St. Bound B to the south by Paatrick St. and d Buttles St. The aeriaal extent of the t 2013 Phaase I implem mentation areea to the eastt of Michigaan Operationns is: Bound B to the north by Baay City Road d, with somee properties on the northh side of thee road being sampled. Bound B to the west by Sau uve Rd. Bound B to the east by Sam m St. Bound B to the south by Maark Putnam Rd. R Table 2-1 1 presents th he properties included in the 2013 Phhase I Implem mentation acctivities. Thhese areas are also shown with more detail d on Fig gures 2-4 andd 2-5. 3 The D Dow Chemicall Company – M Michigan Operrations 20113 Work Plan aand Adaptive M Management R Report 2.2.1 Sampling Pla ans The follo owing sectio ons present the specific details for those Decission Units (D DUs) in thee area described d above. Th here is one no on-residentiaal property w with woodedd areas preseent (Parcel 14-1550-650). This prop perty is not scheduled for samplinng but the pproperty willl have landd use monitorin ng as requireed by Sectio on 7.6.3 of th he work plann. The prelim minary samppling inform mation is provid ded in Tablee 2-1, includ ding property y size and tthe number of incremennts. The plaanned incremen nt sample locations l maps for eacch individuaal DU werre submittedd to MDEQ Q on September 6, 2012. 2.2.1.1 Residential R DUs < 1 Accre There aree 295 DUs in the 2013 Phase I Areea that are lless than onne (1) acre inn size. Of tthese, there are 264 DUs th hat are ¼-acrre or smallerr, where ten (10) increm ments will be collected. T There are 31 DUs D remain ning that aree greater th han ¼-acre, where twennty (20) inccrements wiill be collected d, as listed in n Table 2-1. 2.2.1.2 Residential R DUs > 1 Accre There is 1 Residentiial DU in th he 2013 Phaase I Area tthat is greateer in size thhan one (1) acre. Parcel 14 4-15-50-636 6 (1.87 Acrees) is zoned d RB (Residdential) and is a large oopen green sspace within a residential r area. a Samplees will be ob btained usingg thirty (30) increments. 2.2.1.3 Non-Residen N ntial DUs In the 20 013 Phase I Area, there are 22 non-rresidential pproperties whhich will bee addressed uunder the Mon nitoring Prog gram (Section 7.6.3 off the Work Plan). Thhese propertties are listeed in Table 2-1 1. The land use of thesee non-residen ntial propertiies generallyy appears to be as follow ws: 19 Commerciial / Retail business parccels; 2 Undevelopeed parcels (1 14-15-50-147 7 and 14-15--50-650); annd 1 Church with h a large parrking lot (14-23-20-004)). These prroperties aree not curren ntly being used as a ressidence, norr are they rresidential-like in 4 The D Dow Chemicall Company – M Michigan Operrations 20113 Work Plan aand Adaptive M Management R Report nature; th herefore, theey are includ ded in the Mo onitoring Proogram (Section 7.6.3 of the Work Pllan). 2.2.1.4 Status S Summ mary Of the 29 95 properties included in n the 2013 Phase P I Areaa, 266 propeerty owners granted acceess to their pro operties for sampling. Of these 266 properrties, sampliing has beeen completeed at 259 prop perties. Thee property owners o of the t remaininng 7 properrties grantedd access to their propertiees for sampling but requ uested that sampling s ac tivities be ddeferred untiil the springg (see Table 2-1 1). A total of o five propeerty owners declined d access. 2.3 2013 Phase II I 2013 Ph hase II encompasses the areas described below, tottaling 195 properties with approxim mately 51.5 acres a of prop perty that is in i residentiaal (42.5 acress) or residenntial-like (8 aacres) use. Rou ughly 1 acre in this area is in non-reesidential usee. The aeriaal extent of tthe 2013 Phaase II implemen ntation area to the north and northwest of the M Midland Facillity is: Bound B to the north by Geeorge St., Haaley St., and Colorado Stt. Bound B to the west by Geo orge St. and Colorado Stt. Bound B to the east by Bayliss St. and Swede S Rd. Bound B to the south by Caarpenter St., North St., A Arbury Pl., annd Patrick R Rd. n of one prop perty (14-21 1-10-024) fro om the Econnomic Develoopment Zonne along Jeffferson A portion Avenue will w be inclu uded in 2013 3 Phase II. There are nno propertiess to the east of the facility in Phase II. Table 2-2 presents the propertiies includedd in the 20113 Phase III Implementtation activitiess. This area is also show wn on Figure 2-6. 2.3.1 Sampling Pla ans The follo owing sectio ons present the t specific details for those DUs in the area described abbove. There aree no propertties with woo oded areas > 7,200 squaare feet (sq fft) in 2013 P Phase II that need to be maanaged as a separate s DU U per Section n 7.4.3 of thee Work Plann. R DUs < 1 Accre 2.3.1.1 Residential There aree 200 DUs in i the 2013 Phase II Arrea that are lless than onne (1) acre inn size. Of tthese, there are 185 DUs th hat are ¼-acrre or smallerr, where ten (10) increm ments will be collected. T There D remain ning that aree greater th han ¼-acre, where twennty (20) inccrements wiill be are 15 DUs collected d, as listed in n Table 2-2. H However, thhe bulk of tthe propertyy is a fenced-in n gravel lot for junked vehicles. v Ro oughly 0.13 acres of thee property haave a distincct use from the remaining portion. p Thee 0.13 acres of yard surrrounding thee house on tthe parcel w will be established as a ressidential or residential-llike DU, w with the rem maining 0.600 acres beinng in non-resid dential use. A drawin ng showing the planneed incremennt sample llocations for the residentiaal or residen ntial-like DU U is included in Attachmeent A. Parcel 14 4-16-40-318 has a total area a of 0.29 acres. How wever, this paarcel is beinng segregatedd into two DUss, as it contaains a recenttly combined d parcel thatt formerly ccontained a ddwelling, annd the second DU D is being evaluated fo or the reason nably anticippated future use that a neew dwellingg may be constrructed on thiis portion off the property y. Portions of parcel 14 4-16-30-600 0 containing public areaas adjacent tto residentiaal areas are bbeing included as residentiaal-like. Fivee (5) DUs haave been estaablished for sampling puurposes as part of 2013 Phaase II sampliing. Parcels 14-15-50-414 1 4 and 14-15 5-50-418 weere determinned to have rresidential oor residentiaal-like land use and were co ombined to create c one sam mpling DU. Th his property y did not haave an assig gned parcel number, buut is ownedd by the Ciity of Midland.. It is a totall of 0.46 acrees. 4-15-40-350 has a total area of 0.45 5 acres. Thiis parcel conntains apartm ments and ggrassy Parcel 14 lawn. A portion of the property y directly ad djacent to thhe apartmennts is separaated by a privacy berm and d shrubs. The T parcel is i being separated into two (2) DU Us to accounnt for potenntially different exposure sccenarios. Parcel 14 4-15-50-461 contains a public p park and a playgrouund equipmeent area. Thee total area oof the parcel is 0.6 acres. The T parcel iss being separrated into tw wo (2) DUs too account foor the more rrecent soil distu urbance and different d maaterials placeed under andd adjacent to the playgrouund equipment. Parcel 14 4-15-50-550 0 is a large lawn and grrassy field aaround a sm mall communnity organizzation building. The total parcel p area off 2.06 acres is being sepparated into tthree (3) DU Us. 2.3.1.2 Residential R DUs > 1 Accre There aree 3 Residenttial DUs in the t 2013 Phaase II Area tthat are greaater in size tthan one (1) acre. Parcel 14 4-15-40-130 was divided d into three DUs, being 14-15-40-1330A (1.28 A Acres), Parceel 1415-40-13 30B (1.26 accres), and Parcel 14-15--40-130C (11.24 acres) aare zoned R RA3 (Resideential) and the property is a large com mmon area situated in the center oof a block of houses ccalled his property is grassy with w scattereed trees.Sam mples will be obtained uusing Parkwood Park. Th 0 incrementss) from each area. thirty (30 2.3.1.3 Non-Residen N ntial DUs Based on n preliminarry evaluation n, in the 2013 Phase III Area, theree are two (22) non-resideential propertiees which willl be addressed under th he Monitoriing Program m (Section 7.6.3 of the W Work Plan). Th hese propertties are listed d in Table 2--2. The cu urrent land use u will be veerified durinng the Year 2 Implementtation activitiess and they will w be includ ded in the Monitoring M Prrogram (Secttion 7.6.3 off the Work P Plan). If they are a found to be used as a residencee or are resiidential-like in nature, sampling will be proposed d during thee Year 2 Im mplementatio on. Monitooring results will be suummarized inn the Annual Report. R 2.4 2014 Phase I (Early Kicckoff) 2014 Phaase I encomp passes the arreas describeed below, tottaling 348 pproperties wiith approxim mately 126.5 accres of prop perty that is in residenttial (104 accres) or resiidential-like (2.5 acres)) use. Roughly 20 acres in this area arre in non-ressidential usee. The aeriaal extent of the 2014 Phhase I implemen ntation area to the north and northwest of the M Midland Facillity is: Bound B to the north by Wy yllys St., E. Haley St., E Eastlawn Dr., and Carpennter St. Bound B to the west by Rod dd St., Jefferrson Ave., S Scott St., andd Colorado S St. Bound B to the east by Sweede Rd., Wasshington St.,, Scott St., annd State St. Bound B to the south by Pin ne St., Haley y St., Airfield Ln., and C Colorado St. The aeriaal extent of the t 2014 Phaase I implem mentation areea to the eastt of Michigaan Operationns is: Bound B to the north by Baay City Rd. Bound B to the west by Sam m St. Bound B to the east by Dick k St. Bound B to the south by Schuette Rd. One prop perty, an asssisted living facility, enccompasses tw wo parcels ((14-15-60-3660 and 14-15-60492). Th he buildings are built in a circular paattern with an interior coourtyard areaa and the extternal lawn areaa. T There are 77 DUs D remain ning that aree greater th han ¼-acre, where twennty (20) inccrements wiill be collected d, as listed in n Table 2-3. 2.4.1.2 Residential R DUs > 1 Accre There arre six (6) Residential orr residentiall-like properrties in the 2014 Phasee I Area thaat are greater in n size than one o (1) acre and are all zoned z for RB (Residenttial) use. Thee properties were separated d into 19 DU Us, described d below: Combined C Paarcel 14-15-6 60-360 and Parcel P 14-155-60-492 (4.77 acres) is thhe grassy extterior laawn common n area of an assisted liviing complexx. These parrcels were suubdivided intto six (6 6) DUs for sampling purrposes; Parcel 14-15--60-601 (3.6 65 acres) is an empty ggrassy propeerty with scattered treess that seerves as a co ommon areaa for the surrrounding conndominiumss. Hoowever, thiss parcel is bbeing seegregated in nto two DUss, for the reaasonably antticipated futture use thatt a new dweelling may m be constrructed on the portion of the propertyy along Sam m Street; Parcel 14-23--30-460 (1.2 23 acres) is a field adjaccent to a resiidential propperty; is therrefore reesidential-lik ke, and was subdivided s into i two (2) DUs for sam mpling purpooses; and Parcel 14-23--462 (1.59) is a large reesidential prroperty and was subdiviided into tw wo (2) DUs D for samp pling purposses. Samples will be obtaained using th hirty (30 inccrements) froom each areaa. N ntial DUs 2.4.1.3 Non-Residen Based on preliminaary evaluatio on, in the 2014 Phasee I Area, tthere are 188 non-resideential propertiees, listed on Table T 2-3.
