Gray Manager, Nuclear Programs Power Plant Assessment Division Maryland Department of Natural Resources 580 Taylor Building Annapolis, MD 21401 SUBJECT: RESPONSE TO COMMENTS ON THE CALVERT CLIFFS NUCLEAR POWER PLANT UNIT 3 FINAL ENVIRONMENTAL IMPACT STATEMENT Dear Ms. Gray: The U.S. Nuclear Regulatory Commission (NRC) staff has received your letter dated June 17, 2011, transmitting the Maryland Department of Natural Resources (Maryland DNR) and Maryland Department of the Environment (MDE) comments on the Calvert Cliffs Nuclear Power Plant Unit 3 (CCNPP) final environmental impact statement (FEIS), which was issued May 13, 2011. The FEIS is a final document that will not be revised or reissued. However, the NRC appreciates your comments on the FEIS, and your comments letter and this response are now part of the formal record for the CCNPP combined license application environmental review. Your comment letter has been added to our Agencywide Document Access and Management System (ADAMS) under Accession No. ML111940205. ADAMS is accessible at http://www.nrc.gov/reading-rm/adams.html. Below is a summary of your comments and the NRC response or acknowledgement. Groundwater (Section 5.2.2.2) The MDE states that UniStar has not requested permission from the MDE to use ground water as an emergency backup water supply. The NRC acknowledges this correction. MDE states that UniStar now proposes the Patapsco aquifer instead of the Aquia aquifer as the source of the backup water supply. The NRC acknowledges the Patapsco as a candidate for this backup supply and awaits documentation referencing the Patapsco as the proposed source. The State does not agree with the NRC’s characterization and explanation of the groundwater use impact as small as it relates to the Aquia aquifer as the emergency backup water supply during operation. The NRC considers the use of this backup water supply an unlikely event of a temporary nature and, in accordance with our impact definitions (see Table B-1 of 10 CFR 51 Subpart A, Appendix B), concluded that the impact to groundwater use from Unit 3 operation would be small. The NRC agrees that a change from the Aquia to the Patapsco aquifer for the source of this emergency backup water supply likely would present less of an impact on the aquifer and other users. S. Gray -2- Air Quality The MDE requests a clarification that states that if there are any inconsistencies between the most recent Certificate of Public Convenience and Necessity (CPCN) case for CCNPP Unit 3 (Case 9218) and conclusions regarding mitigation in the FEIS, that the CPCN Case 9218 would take precedence. The NRC agrees with this clarification. Maryland DNR/MDE also requests clarification regarding the air quality conformity determinations that will be completed by both the NRC and the U.S. Army Corps of Engineers (USACE or the Corps). The NRC’s air conformity determination, which will be completed prior to the Commission decision on whether or not to grant a combined license for CCNPP Unit 3, will include more detailed discussion of what activities are covered by the NRC’s Federal action. The Corps will issue its own air conformity determination for its agency’s action. Further comments on the FEIS air quality analyses, including those regarding the total number of certified emission reduction credits needed by the CCNPP project, permits that cover only stationary sources, and MDE as the air permitting agency, will be correctly reflected in the NRC’s forthcoming conformity determination document. The NRC agrees that in the specified places listed by MDE/PPRP the word “stationary” should be added before air pollution sources. In response to the question concerning why cooling tower emissions are not discussed in the air quality section of the Thiokol alternative sites analysis (Section 9.3.5.8), it is because St. Mary’s County, where the Thiokol site is located, is in attainment for all air quality standards. The other alternative sites (Bainbridge and Eastalco) are in or immediately adjacent to counties that are not in attainment for PM 2.5 (particulate matter with a diameter of less than 2.5 microns). The NRC asserts that a cooling tower for a power plant would be an additional source of particulate matter, resulting in a MODERATE cumulative impact at these two sites. Maryland DNR correctly points out that a reference to the Eastalco site in the third paragraph of Section 9.3.5.8 should instead be a reference to the Thiokol site and that industrial sources would be subject to regulation by MDE, not the Maryland DNR. Transportation (Section 4.4.4.1) The NRC notes PPRP’s disagreement with the conclusion in this section; however, the NRC maintains that transportation impacts during construction of CCNPP Unit 3 would be MODERATE, and that UniStar could implement traffic mitigation activities to reduce this impact or the Maryland State Highway Administration could require additional mitigation during its review of the project.
