Description and Justification
The purpose of this contract is to replace the air handling units within the main
warehouse including the demolition of existing overhead unit heaters and utilization of
surplus Trane Voyager heating and cooling units. Existing unit heaters at the DTMB
Records Building are beyond their useful life and in continuous need of repair. In
addition, due to the location of many of these existing unit heaters, access for repairs is
a safety issue placing maintenance staff at risk, requiring training in fall protection and in
the use of personal protective equipment. The Trane Voyager heating and cooling units
were originally installed at the Michigan State Fair Grounds in 2006 and were salvaged
by DTMB in 2009 when the State Fair Facility was closed. Use of the salvaged units
significantly reduces project construction costs.

Description and Justification
The purpose of this contract is to construct new facilities required to relocate the

Transportation Services (WS) downtown motor pool operations, currently located on
the upper level of the Allegan parking ramp, to the first and second levels of the Hall of
Justice east parking ramp. The project scope of work includes: construction of a new
VTS motor pool office building; a new two (2) bay vehicle service building with
assoCiated service equipment; an ADA compliant, unisex rest room facility for both staff
and customer use; relocating the existing vehicle key vending kiosk and security
camera. This move will allow a greater number of Motor Pool parking spaces for
increased utilization of the motor pool. It will also allow the facilities division to increase
the number of spaces rented in the Hall of Justice parking ramp and provide more
Allegan Ramp parking to state employees.

Description and Justification
The purpose of this contract is to remove concrete sidewalks and asphalt pavement in

surface. The reconstruction of six (6) parking lots and selective reconstruction of
sidewalks and ramps will meet current ADA standards. The four employee surface lots
are badly deteriorating, have large cracks, some exceeding 3-4". The original two
customer lots are in excess of 30 years old and need replacement. The existing control
gates have exceeded their normal life expectancy. The parking lots require constant
and costly maintenance and repair.

The purpose of this contract is to reconstruct the entrance road by milling, shaping and

degradation. The entrance road currently has Pavement Surface Evaluation and Rating
(PASER) scores of 2 and 4 (a scale of 1 to 10, 10 being excellent).

Description and Justification
The purpose of this modification is to provide final design/construction documents and
construction administration services to upgrade controls for the Michigan State Police

to better reflect the current operation of the laboratories including airflow adjustments to

LEASE FOR PRIVATE PROPERTY
8. DEPARTMENT OF STATE, OAK PARK — New Lease No. 11574 between
Parkwoods Plaza Center, LLC, 4036 Telegraph Road, Suite 201, Bloomfield
Hills, 48302, as Lessor, and the State of Michigan by the Department of
Technology, Management & Budget for the Department of State, as Lessee, for
5,001 square feet of office space located at 13401 W. Ten Mile Road, Oak Park,
MI 48237. The Lease is effective upon obtaining State Administrative Board
approval and required signatures. The annual per square foot rental rate for this
space beginning September 1, 2012, or upon substantial completion, is $16.00
($6,668.00 per month). This is a full service Lease. This Lease contains two 5year renewal options with an annual per square foot rental rate of $17.60
($7,334.80 per month). This Lease contains a Standard cancellation clause with
90 days notice. The Attorney General has approved this Lease as to legal form.
Purpose/Business Case:
This Lease is a new location and will provide services to the citizens in a centralized
area of Oak Park.
Benefit:
This Lease will provide a cost savings of over $4,500 per month or $54,000 annually.
This is due to the new space being a full service lease, smaller (over 27%) and more
efficient.

ADDENDUM TO LEASE FOR STATE-OWNED PROPERTY
9. DEPARTMENT OF TECHNOLOGY, MANAGEMENT AND BUDGET, LANSING Addendum No. 1 to Lease No. 11061 effective August 1, 2012, through
November 30, 2014, with Lake Trust Credit Union, 501 South Capitol Avenue,
Lansing, MI 48933, as Lessee, and the State of Michigan by the Department of
Technology, Management & Budget as Lessor, for a total of 344 square feet of
office space used for siting Automatic Teller Machines (ATMs) at various Stateowned office buildings in the Lansing area. This Addendum reduces the total
leased area 24 square feet by eliminating an ATM site at the Hall of Justice
located at 925 West Ottawa Street, Lansing, MI 48933. Effective August 1, 2012,
the new total leased area will be 320 square feet split among nine remaining
ATM locations. Effective August 1, 2012, the annual rent shall be reduced
accordingly by $476.16 to $6,351.84 ($529.32 per month). This Lease contains
an Either Party cancellation clause with 90 days notice. The Attorney General
has approved this Lease as to legal form.
Purpose/Business Case:
This Addendum provides for a reduction in leased space and a commensurate rent
reduction as requested by the Lessee, Lake Trust Credit Union.
Benefit:
This Addendum allows the State to accommodate the Lessee's space reduction request
without having to cancel the entire Lease and disrupt ATM services even more widely.
The State retains its right to have ATM services in the premises vacated by Lake Trust
Credit Union provided by other financial institutions.

Commitment Level:
Through November 30, 2014; however, the Lease contains an Either Party cancellation
clause with 90 days notice.
Risk Assessment:
Non-approval of this Addendum will hinder the Department from accommodating the

ADDENDUM TO SUBLEASE FOR PRIVATE PROPERTY

RAPIDS - Addendum No. 3 to Sublease No. 10954 approved by the State
Administrative Board on April 2, 2002, Item No. 11, between The City of Grand
Rapids, a Municipal Corporation, 300 Monroe Avenue NW., Grand Rapids, MI
49503, 'as Sublessor, and the State of Michigan by the Department of
Technology, Management & Budget for the Department of Technology,
Management & Budget, as Sublessee, for 137,000 square feet of space located
at One North Division Avenue, Grand Rapids, MI 49503. This Addendum
provides for a rental rate reduction beginning October 1, 2012. This Addendum is
effective upon obtaining State Administrative Board approval and required
signatures and continues to the termination date of the Sublease, or any
extension. The annual rental rate for this space beginning October 1, 2012, shall
not exceed $2,700,000.00 per year. The actual rental amount will be set once
the Grand Rapids Building Authority bonds are sold. This Addendum contains a
Legislative cancellation clause with 60 days notice. The Attorney General has
approved this Addendum as to legal form. The Sublease met the criteria
requiring approval of the Joint Capital Outlay Subcommittee of the Legislature.
The Subcommittee approved the Sublease on June 6, 2001.
Purpose/Business Case:
The purpose of this Addendum is to reduce the rental rate. The Department is satisfied
with the current location. The Lessor has kept the property in good condition and has
been responsive towards the needs of the Department.
Benefit:
The Addendum allows the Department to secure a rental rate savings of approximately
$124,000.00 per year while remaining at their current location, thereby avoiding
relocation costs.

100% Restricted Building Occupancy Funds
Commitment Level:
16 years with two 5-year renewal options; however, this Addendum contains a
Legislative cancellation clause with 60 days notice.

CONTRACT CHANGE ORDER
11. DEPARTMENT OF COMMUNITY HEALTH, LANSING - CCO No. 21 for Lease
No. 11080 approved by the State Administrative Board on September 11, 2007,
between The Boji Group, Inc., as Lessor, and the State of Michigan by the

Community Health, as Lessee. This Contract Change Order (CCO) provides for
labor and materials needed to install audio and video equipment in the Manty
Conference Rooms A B and C on the first floor of the Capitol View Building at a
cost not-to-exceed $14,177.30. The space is located at 201 Townsend, Lansing,
MI 48933.
Purpose/Business Case:
The purpose of this COO is to replace the current outdated and ineffective sound
system in the Manty Conference Rooms with modern and far more capable audio-visual
technology.
Benefit:
The CCO will enable the agency to realize the full potential of the Manty Conference
Rooms for holding large group meetings. All conference participants will then be able to
see and hear presentations or participate in a teleconference more effectively. This
CCO will also improve meeting records by accurately capturing all presentation content
including audience questions and comments.
Source of Funds:
100% General Funds
Commitment Level:
Present through September 30, 2026; however, this Lease contains an Executive New
cancellation clause with 90 days notice.
Risk Assessment:
Non-approval of this CCO will hinder the Department from using the Manty Conference
Rooms in the subject space for the purposes intended because the existing conference
room audio/visual technology is antiquated and ineffective at facilitating larger groups.

— PHASE I AND II GROUP A SPECIAL MAINTENANCE ROOF REPAIRS
Purpose/Business Case
The State Building Authority is the State's primary capital outlay funding mechanism for
projects that would otherwise be paid for by the General Fund. Costs for roofing
projects at multiple state facilities were financed by the Authority and leased to the State
of Michigan in 2008. The bonds associated with these Facilities have been paid in full.
Benefit
The approval of this resolution will allow the State Building Authority to convey its
interest in the roofs at various state facilities back to the State of Michigan

Description and Justification
The purpose of this change order is to replace two heating water pumps and related
piping and electrical work and balancing the building's hot water heating system. This
request is an agency-requested scope change. The existing hot water pumps are not
large enough to supply the required water flow and meet total building demand.
The replacement of the existing heating water pumps was not requested in the original

The purpose of this memorandum is to request your approval to submit the proposed
bottomlands deed to the State Administrative Board. The Water Resources Division (WRD)
recommends approval of the deed to an existing 0.16-acre parcel of filled Lake St. Clair public
trust bottomlands, in the St. Clair Flats, Middle Channel Section, Clay Township, St. Clair
County, pursuant to Part 339, Control of Certain State Lands, of the Natural Resources and
Environmental Protection Act, 1994 PA 451, as amended (NREPA).
Legal Description of Subject Bottomlands
A parcel of land located in and being a part of Lot 335 of the Middle Channel Section of the
so-called St. Clair Flats Survey, 1899 PA 175, Clay Township, St. Clair County, and being more
particularly described as follows:
Commencing at the northeast corner of said Lot 335; thence S 43° 41' 30" E along the east line
of said Lot 335 67.43' to the point of beginning; thence N 73° 52' 00" E 2.90' to the edge of a
wood seawall; thence S 45° 42' 01" E along said wood seawall 62.08'; thence S 73° 52' 00"
W 145.81'; 'hence N 16° 07' 36 W 54.00'; thence N 73° 52' 00" E 112.27' to the point of
beginning, containing 0.16 acres, more or less, subject to any and all easements of record.

Discussion and Background
The subject lot Is currently leased from the State of Michigan pursuant to Part 339 and used as a
seasonal cottage.
Recent amendments to Part 339 provide the Department of Environmental Quality (DEQ) with the
authority to issue a deed for the filled area of the leased lot under certain conditions. This parcel
meets those conditions, as the filled area is protected by a seawall on one side and shares
boundary lines with two adjacent cottages. The area is maintained lawn and has an approved
septic system to serve the cottage.
The applicant wishes to convert the existing filled area on the subject lot to a deed to obtain the
State of Michigan's ownership interest in the Lake St. Clair public trust bottomlands occupied by
this filled area of the leased lot. The DEC determined, pursuant to Part 339, the full consideration
to be paid to the State of Michigan is $5,915.

The applicant, vino is the current leaseholder, has provided a satisfactory survey, and the taxes are
paid up to date. This item appeared in the January 30, 2012, DEQ Calendar and was eligible for
approval beginning February 6, 2012. The investigation conducted by DR) staff concluded that
the described lands have no substantial value for hunting, fishing, swimming, pleasure boating,
or navigation, and that the public trust in the remaining lands and waters will riot be impaired by
the sale of said described lands.
Recommendations
It is recommended that the above described parcel be authorized for a deed pursuant to Part 339
and Executive Order 2011-1 with the following covenants in the conveyance:
A. The deeded parcel shall be used only for the purpose of residential use.
B. This deed is intended to convey title to only the above described portion of the yard and
garage of the subject area of Lot 335 of the Middle Channel Section of the so-called
St. Clair Flats, made under the provisions of 1899 PA 175. The issuance of this deed
terminates the leasehold interest of the grantee in this parcel.
C. A permit for dredging, filling, or placing pemment structures outside the limits of the
deeded parcel shall be subject to the provisions Part 325, Great Lakes Submerged Lands,
of the NREPA.
After the Director of the DEQ approves this recommendation with his signature, this
memorandum will be forwarded for review and approval to the State Administrative Board as
required by Part 339. Upon approval by the Administrative Board, the WRD will execute the
legal documents authorizing the bottomlands conveyance.

last steps of receiving a deed to the lighthouse from the National Park Service (NPS). The grant
of the subject private use agreement will finalize the issuance of the NPS deed. The applicant
has been restoring the lighthouse to Its historic condition for several years under an agreement
with the U.S. Coast Guard. The NIPS deed and associated covenant has conditions that require
the applicant to continue with this preservation and maintenance,work. The proposed private
use agreement would provide the applicant with the authorization from the State of Michigan to
occupy the subject Lake Huron public trust bottomiands for the described purposes.
The applicant has provided the necessary proof of ownership, a satisfactory survey, local
government approvals, and a $50 filing fee. No adverse comments to this proposed private use
agreement have been received from the Department of Natural Resources' Parks and
Recreation Division, the Department of Community Health, the U.S. Army Corps of Engineers,
or the general public. The investigation conducted by DEG staff concluded that the applicant
may occupy and use the water area and the described unpatented bottomlands without
impairing or substantially Injuring the public trust.
Recommendations
It is recommended that the DEQ approve the application to have the above described bottomlands
conveyed by private use agreement to the applicant under authority of Part 325, being
Sections 324.32501 to 324.32515 of the Michigan Compiled Laws Annotated and Executive Order
2011-1. The proposed conveyance appeared in the DEQ Calendar June 4, 2012, and was eligible
for approval beginning June 11, 2012.
The recommendation for the private use agreement will include the following conditions, in
addition to standard conditions, as approved by the Department of Attorney General:
1. The term of this agreement is 50 years from and after the date of execution of this
agreement by the DEQ, provided that the subject bottomlands are used for the purposes of
preservation and maintenance work of the Port Austin Reef Lighthouse, as required by the
NPS deed and associated covenant. The proposed use agreement shall be null and void if
the facility is converted to another use. Renewal for an additional 49-year term may be
granted upon request of the applicant and upon a determination by the DEQ that all the
conditions of the NPS deed and associated covenant have been met during the first term.
2. Grantor agrees that Grantee's restoration, maintenance, and operation of the Port Austin
Reef Lighthouse in accordance with the covenant and deed, and the public interest served
by the Grantee preserving and making available to the public an important part of
Michigan's maritime heritage, constitutes adequate consideration for this agreement.
3. This agreement authorizes the use and occupancy of 0.14-acre of Lake Huron bottomlands for
preservation and maintenance work of the Port Austin Reef Lighthouse as required by the
NPS deed and associated covenant.

*HIGHWAYS - IDS University Research Services
Authorization (1) under Contract (2012-0635) between MDOT and Grand Valley State
University (GVSU) will provide for a study of the remanufacturing, repurposing, and
recycling of lithium-ion batteries in public transit vehicles. The university will develop
supply-demand and recycling models, identify constraining issues, design and implement
manufacturing processing techniques for overcoming these issues, and estimate the
economic impact of such developments. The authorization will be in effect from date of
award through December 31, 2013. The authorization amount will be $259,428.22. The
contract term is July 25, 2012, through July 24, 2016. Source of Funds. Federal Highway
Administration Funds — $100,000; State Restricted Trunkline Funds — $50,000; GVSU
Funds - $109,428.22.
2.— 62. HIGHWAYS (Maintenance) - State Trunkline Maintenance
The following contracts between MDOT and the following county road commissions will
provide for statewide trunldine maintenance to be performed for a one-year period. The
contracts will be in effect from October 1, 2012, through September 30, 2016.
Public Act (PA) 17 of 1925 authorizes MDOT to contract with cities, villages, and boards
of county road commissioners for the construction, improvement, and maintenance of
state trunkline highways. Under the terms of the standard maintenance contracts, the
cities, villages, and boards are reimbursed for audited labor, equipment rental, and
material charges in accordance with the provisions of the contracts. These maintenance
contracts were not competitively bid but were negotiated with the local units of
government. MDOT has found that such negotiated agreements are in the public interest
and has transmitted those findings in accordance with Section 11c of 1951 PA 51, MCL
247.66a(c).
