REVISIONS TO OPEN-SPACE STATUTES
FEGARDING LABORF;R HOUSING
On July 27, 1980 the Governor approved Senate B i l l 1747, Chapter 764,
and on September 27, 1980 he approved Assembly Bill 2481, Chapter 1219.
These a c t s amend Gavernment Code Sections 51220, 51231, and 51238 and
add Section 512B2.3 r e l a t i n g t o a g r i c u l t u r a l preserves and w i l l be
applicable f o r the I W l l i e n date, These sections include use f o r
a g r i c u l t u r a l laborer housing as a compatible use f o r properties
r e s t r i c t e d by a land conservation contract.
Agricultural laborer housing includes housing f o r temporary and/or
permanent laborers and t h e i r f a m i l i e s . Such housing does not include
the residence of any person with an ownership i n t e r e s t i n the property
i n which case Revenue and Taxation Code Section 423 will s t i l l apply.
Both existing and new s t r u c t u r e s can be u t i l i z e d f o r agricultural
laborer housing.
An example of a g r i c u l t u r a l laborer housing would be a house rented
by a farm laborer as his permanent residence (no ownership i n t e r e s t
i n t h e house o r land). The land used f o r t h a t residence i s included
as part of the r e s t r i c t e d land when t h e property i s r e s t r i c t e d by a
land conservation contract.
