In support of the relief requested in this Application, the Company respectfully represents to the Commission as follows: 1. Applicant is a wholly-owned subsidiary of DTE Energy, supplying retail electric service to customers located in Michigan, and is a public utility subject to the jurisdiction of the Commission. 2. Applicant is presently serving its electric customers under schedules of rates and charges approved by this Commission in its Orders dated December 11, 2015 and January 19, 2016, in Case No. U-17767 (“U-17767 Orders”), and pursuant to various special contracts approved by the Commission. 3. This Application is being filed in accordance with filing requirements contained in the Commission’s Order in Case No. U-15895, dated December 23, 2008, implementing 2008 Public Act No. 286 (“Act 286”). 4. The Company has determined the need for additional annual revenues in the amount of approximately $344 million effective as soon as possible in 2016, in order to recover, inter alia, the Applicant’s costs associated with the capital costs associated with the addition of plant involving generation and the electric distribution system; capital structure cost changes; the operation and maintenance of Applicant's electric distribution system and generation plants; environmental compliance and the costs associated with inflation. 5. This filing reflects DTE Electric’s continuing efforts to control and, where possible, reduce costs, through sustainable and on-going Continuous Improvement (CI) efforts. These CI activities have helped the Company mitigate the impact of increasing routine operating costs without reducing the quality of service to customers. Thus, DTE Electric’s O&M costs over the last five years have increased at a much slower rate than the rate of inflation. 6. The proposed revenue increase described in this Application is necessary in order to allow the Company to continue to provide safe and reliable electric service, to meet customers’ service quality expectations, and to allow the Company a reasonable opportunity to recover its costs of operation, including a reasonable rate of return. 7. In the event that the company elects to self-implement a rate increase consistent with the provisions of MCL 460.6a such increase would likely occur on August 1, 2016. 8. The historical test year period being used by DTE Electric is the calendar year ended December 31, 2014. This 12-month period was then normalized and adjusted for known 2 and measurable changes, as supported by the Company’s witnesses in this case, to arrive at the Company’s August 1, 2016 through July 31, 2017 projected test year. 9. DTE Electric’s projected rate base of approximately $14.5 billion includes actual net plant and working capital as of December 31, 2014 with projected changes through July 31, 2017 and includes the impact of base capital expenditures and further adjustments for specific major projects. Major capital projects during the projected period ending July 31, 2017 are described in the testimony and exhibits of the Applicant’s witnesses. 10. Thus, the Applicant's testimony and exhibits filed contemporaneously with this Application evidence a need for additional annual revenue in 2016 of approximately $344 million. 11. Attachment 1 to this Application summarizes the Company's request. DTE Electric proposes to allocate the required electric revenue increase among rate classes as set forth on Attachment 2 to this Application. A comparison of typical bills and proposed rates for Residential Service Rate D1 is shown on Attachment 3 to this Application. In addition, the Proposed Draft Notice is included as Attachment 4 to this Application. 12. The Commission, in DTE Electric’s last general rate case (Case No. U-17767), approved the use of a cost allocation methodology based on 50% peak demand for 12 coincident peaks (CP), 25% on-peak energy and 25% total energy use (referred to as 50-25-25) to determine how MPSC jurisdictional power supply and transmission costs are allocated to the retail rate classes. DTE Electric now proposes, consistent with the Company’s proposals in Case No. U-17689, that production cost allocation should be based on a 100% demand 4 CP allocation (4CP 100-0-0) since the proposed 100% demand allocation more appropriately aligns cost recovery with cost causation. This method reflects the increased emphasis on production capacity, rather than 3 energy, which is necessary given the need for new production capacity in the future and the investment necessary to retrofit existing generation to meet environmental standards. 13. DTE Electric is proposing modifications to the Retail Access Service Rider EC2 tariff inserting a provision which clarifies the Company’s specific metering requirements for current electric choice customers who want to expand their existing load. In addition, the Company is proposing changes to the Outdoor Lighting tariff including; (1) establishment of an underground service option for Outdoor Protective Lighting, (2) movement from the Experimental Emerging Lighting (EEL) Technology Tariff Provisions established in 2010 to a standard tariff rate for Light Emitting Diode (LED), (3) elimination of the de-energized and dusk to midnight rates currently available to municipal lighting customers, (4) establishment of a Special Order Material charge, (5) elimination of various street light product offerings, (6) replacement of percentage-based surcharges with volumetric surcharges for unmetered outdoor lighting and traffic signal rate classes, and (7) revision of the financing option available to lighting customers. 14. The Company is also proposing an expansion of its Demand Side Management program and its Interruptible Air conditioning Program. 15. DTE Electric is also seeking cost recovery of its variable compensation programs that are used to attract and retain employees with the requisite skills and experience to ensure quality customer service; ensure that DTE Electric’s employees’ total compensation is externally competitive; and that differentiate total rewards based on organizational and individual contributions. The Company is not seeking to recover the variable compensation for the top five DTE Energy executives. 16. DTE Electric is requesting a return on equity of 10.5% with an overall rate of 4 return of 5.71% after tax, 8.23% pre-tax. The Company is requesting a permanent capital structure of approximately 50% equity and 50% long-term debt. The projected average rate base for the test year is approximately $14.5 billion, which includes an equity base of approximately $5.4 billion. 17. Applicant is requesting that the Commission adopt the PSCR base established in the Commission’s Order in Case No. U-15244 on January 13, 2009. 18. DTE Electric received a Combined Operating License (COL) for a new nuclear generation unit on May 1, 2015. Applicant is requesting recovery of all expenditures, including an appropriate return, related to completing the Combined Operating License Application (COLA) for an additional nuclear generation unit at the Company’s Fermi Nuclear site (Fermi 3) and maintaining the license as part of the Company’s long term generation strategy. The Commission approved the initial COLA expenditures in its January 11, 2010 Order in Case No. U-15768 and concluded that the amount expended to obtain the license is reasonable and should be amortized over a 20-year period in its January 19, 2016 Order in Case No. U-17767. 19. The Commission issued Orders on January 11, 2010 in Case No. U-15768, October 20, 2011 in Case No. U-16472, and December 11, 2015 in Case No. U-17767 approving the Company’s Advanced Metering Infrastructure program (“AMI”) and reaffirmed the earlier Orders on remand from the Michigan Court of Appeals on October 17, 2013 and November 6, 2014. Based on the Commission’s directive, the Company is providing in this case a detailed cost benefit analysis, along with a report that describes the program’s success and shortcomings as well as a plan exploring the direct benefits customers receive from the program. The analysis shows the benefits of the project (i.e., the savings attributable to the project) are expected to outweigh the costs of the project. Based on these factors, it is reasonable to conclude that the 5 AMI program will have a positive impact on customers, and that the AMI investments continue to be a reasonable and prudent use of utility resources. In addition, the Company is providing a review of its Opt-Out charges as required by the Commission. 20. DTE Electric is also requesting specific Commission authority to implement certain accounting practices including the continuation of the Other Post Employment Benefit cost (OPEB) deferral mechanism approved by the Commission in Case No. U-17767 that impacts the expense projections and the authority to use account 926, Employee Pensions and Benefits for the cost of the Company’s Supplemental Retirement Plan (SRP) consistent with the Company’s request to include the related expense in the revenue requirement. The Company is also requesting capitalization of certain demand side equipment, amortization of an anticipated regulatory asset for obsolete inventory, regulatory asset treatment for certain tree trim expenditures, recovery of the capital investment for the relocation of certain electric facilities, a provisional Energy Optimization Revenue Decoupling Mechanism program to be deployed in the event that the Michigan Legislature enacts enabling legislation, recovery of expenditures related to additional renewable generation and the inclusion of negative netgeneration fuel costs in the PSCR. 21. Applicant is filing the direct testimony and exhibits of 21 witnesses concurrently with this Application. The contents, recommendations, revenue and expense items and proposed ratemaking items set forth in those documents are incorporated into this Application by reference. 22. The fact that Applicant may not address an item or position addressed by Applicant in previous cases, or which is presently on appeal before the courts, does not constitute a waiver of such item or position by the Company, or of any rights or positions that the Company 6 may wish to take on these matters in this or any other proceedings before the Commission (now or in the future), or in any other appropriate court or venue (now or in the future).. WHEREFORE, Applicant requests that the Commission: A. Accept this Application for filing; B. Give such Notice to interested parties as may be required by statute or the Commission's rules; C. Establish a date, place and time for a prehearing conference; D. Conduct a hearing on this Application in order to determine the just and reasonable rates, effective as soon as possible in 2016, which will provide Applicant a reasonable opportunity to recover its costs of operation, including a reasonable rate of return, in 2016 and beyond; E. Enter its Order approving an additional annual revenue increase effective as soon as possible in 2016 as described herein; F.
