FORWARD MARKETS COMMISSION, MUMBAI
Highlights/ Important Developments for the fortnight from 16.9.2014 to 30.9.2014
1. Total value of trading at the Commodity Exchanges during the fortnight, 16th September, 2014 to 30th September,
2014 was ₹ 2,86,527.94 crore. The cumulative value of trade from 1stApril, 2014 upto 30th September, 2014 during
the financial year 2014-15 was ₹ 29,82,481.33 crore. The corresponding figures for the previous year were
₹ 3, 28,805.86 crore and ₹ 65, 58,571.67 crore respectively.
2. The Commission on 18th September, 2014 conveyed its approval to the appointment of Mr. Kevin Pius D’sa,
representing Bajaj Holdings and Investment Limited and Mr. Rakesh Gupta, representing Punjab National Bank as
Shareholder Directors on the Board of the NMCE, Ahmedabad till the next Annual General Meeting.
3. The Commission on 22nd September 2014 conveyed its approval relating to grant of extension of time for
appointment of Managing Director & CEO of MCX, Mumbai, for a period of 2 months from the date of letter i.e.
3rd September, 2014.
4. The Commission on 22nd September, 2014 conveyed its approval for amendments to the Articles of Association of
NCDEX. By these amendments, the Exchange has incorporated the directives issued by the Commission on 11th
June, 2014 with respect to revised norms on “Constitution of Board of Directors, Committees, Nomination and
Role on Independent Directors and appointment of Chief Executives at the Nationwide Multi Commodity
Exchanges” in the Articles of Association of the Exchange.

5. The Commission reviewed the status with regard to compliance with the order dated 17.12.2013 passed by the
Commission declaring inter alia FTIL as not fit and proper person to be a shareholder in MCX. The progress made
by the Exchange with respect to implementation of the findings in the report of PwC and the Oversight
Committee was also examined on the basis of updates received from the Exchange. Keeping in view the progress
made by MCX in the execution of technology agreement with FTIL which was set as pre-condition for executing
the Share Purchase Agreement (SPA) between Kotak Mahindra Bank Limited (KMBL) and FTIL, and also taking into
cognizance, the progress made by the Exchange in the implementation of the report of the PwC and Oversight
Committee, the Commission, vide its letter dated 17th September 2014 directed MCX inter alia, that Exchange can
launch contracts upto March 2015 as soon as it signed a new technology agreement with FTIL and it can launch all
its contracts for the year 2015 once the divestment of shares held by FTIL in MCX is completed.
On 27th September, 2014, MCX apprised the Commission that it has entered into the master amendment to the
principal agreements with FTIL pertaining to technology support and managed services from FTIL which was a
pre-condition for execution of SPA between KMBL and FTIL. The amended technology agreement comprise the
following key changes in the original agreement:
a) Reduction in tenure upto October 2022
b) Lowering of fixed charge for Software Support & Managed Services from ₹2 crores to ₹1.5 crores per
month.
c) Lowering of variable charge from 12.5% to 10.3% of the gross transaction charges received by MCX on a
monthly basis.

Subsequently on 29th September 2014, MCX informed the Commission that the SPA between KMBL and FTIL has
been executed and KMBL has acquired equity shares aggregating to 15% of stake in MCX from FTIL, making
FTIL’s stake in MCX’s equity zero, thereby fully complying with the order of the Commission dated 17.12.2013 as
well as the revised norms regarding shareholding, ownership, net-worth, fit and proper criteria etc., of the nationwide multi-commodity exchanges issued by the Commission on 06.05.2014. In view of the aforesaid compliances
made by MCX, the Commission on 29th September, 2014 permitted the Exchange to launch their contracts for the
calendar year 2015.
6. In a landmark measure by the Commission to bring effective price discovery and efficiency in physical markets,
first time ever in online Exchanges, Delivery based Forward Contracts were launched on 25th September 2014 by
NCDEX. Forward Contracts in Sugar and Maize were launched in Transferable Specific Delivery (TSD) as well as
Non Transferable Specific Delivery (NTSD) segment. In first 5 days of trading in Forward Contracts, 1040 MT
quantity were traded. Deliveries amounting to 150 MT have been executed and total value of trade for 5 days
stood at ₹ 215.53 Lakhs. This initiative is expected to contribute to considerable improvement in physical markets
by bringing substantial physical trade in the trading and delivery domain of the Commodity Exchanges thereby
reducing costs of intermediation and improving price discovery.
7. Developments at National Spot Exchange Limited (NSEL):
There was one pay out during the fortnight under reference, i.e., pay out scheduled on the 19th September, 2014
of ₹ 1.65 crore.
