PUBLIC WATER SYSTEM ANNUAL COMPLIANCE REPORT
(Calendar Year 2002)
SECTION I: Introduction
The Safe Drinking Water Act (SDWA) Amendments of 1996 included provisions
requiring the States to complete an annual report on violations of national primary drinking water
regulations by the public water systems in their state. This annual report must identify violations
of primary drinking water standard maximum contaminant levels (MCL), treatment
requirements, variances and exemptions, and significant monitoring requirements.
Public water systems served approximately 32.2 million people in California during the
2002 calendar year. Approximately 1.7 million people in California received their drinking
water from other sources, primarily private wells serving individual residences.
The California Department of Health Services (Department) is designated by the United
States Environmental Protection Agency (USEPA) as the primacy agency responsible for the
administration and enforcement of the federal SDWA requirements in California. The State of
California and the Department have adopted statutes and regulations to implement the
requirements of the SDWA. The Department’s regulatory responsibility over public water
systems includes (1) issuance of operating permits, (2) conducting inspections, (3) monitoring
for compliance with regulations, and (4) taking enforcement action to compel compliance when
violations are identified.
The Department has delegated the drinking water program regulatory authority for small
public water systems serving less than 200 service connections to thirty- five (35) counties in
California. The delegated counties (or Local Primacy Agencies) are responsible for regulating
approximately 5,000 small public water systems statewide. The Department retains the
regulatory authority over all public water systems statewide with greater than 200 service
connections and the small public water systems in the remaining twenty-three (23) non-delegated
counties. A list of the delegated counties is included in Appendix C of this report.
The Department submits drinking water regulatory program data electronically to the
USEPA for compilation in the federal Safe Drinking Water Information System (SDWIS) on a
quarterly basis. The data submitted to SDWIS typically includes (1) public water systems
inventory statistics, (2) MCL violations, Major Monitoring and Treatment Technique violations,
(3) the enforcement actions taken by the Department against public water systems for violations,
and (4) variances and exemptions. The USEPA regions also report federal enforcement actions
into the SDWIS database.

During the calendar year 2002, the Department experienced technical problems in the
electronic transmittal of water quality and violations data into the federal SDWIS. As a result,
the information available from the federal SDWIS is considered incomplete and does not
accurately reflect the status of drinking water compliance in the State of California. The
Department is aggressively working with the USEPA to resolve the data transfer issues and
problems to ensure the completeness and accuracy of the SDWIS data in the future.
Consequently, the violations information included in this report is derived from the data
available from the Department’s independent drinking water program database system for the
period of January 1, 2002 through December 31, 2002.

SECTION II: Primary Drinking Water Standards / Water Quality Monitoring
Primary drinking water standards have been adopted by the Department for contaminants
that may be found in drinking water supplies in California. The standards are set at levels
necessary to protect the public from acute and chronic health risks associated with consuming the
contaminants in the drinking water supplies.
Public water systems are required to serve drinking water that meets all of the
Department’s drinking water standards, and to conduct routine sampling and analysis of their
drinking water supplies to certify compliance. Further, all water quality analysis must be
conducted by laboratories that are certified by the Department and the analytical results
transmitted electronically to the Department. The water quality analytical results are reviewed
and evaluated by the Department to determine compliance with drinking water standards. The
Department identifies and reports violations when public water systems submit water quality
analytical results that exceed the established drinking water standards.
Public water systems are required to notify the Department within forty-eight (48) hours
of receiving water quality analytical results indicating a failure to meet any primary drinking
water standard. In the case of a bacteriological or nitrate/nitrite drinking water standard
violation, public water systems are required to notify the Department within twenty- four (24)
hours of receiving water quality analytical results indicating an MCL has been exceeded.
A monitoring violation is reported when a public water system fails to conduct the
required water quality sampling and analysis or to report the analytical results to the Department
or the appropriate Local Primacy Agency.
SECTION III: Variances And Exemptions
The Department is authorized under the federal SDWA to issue variances and exemptions
from meeting drinking water standards to public water systems under special circumstances.

A variance is allowed in situations where the characteristics of a raw water source make
it impossible for a public water system to meet the MCL with the installation of the best
available technology, treatment techniques, or other approved method. The approval of any
variance must ensure adequate protection of human health. Additionally, the variance is
reviewed by the Department not less than every five (5) years to determine whether continuation
of the variance is appropriate and necessary.
An exemption from an MCL and/or treatment technique is allowed in situations where a
public water system is in noncompliance as the result of compelling factors and the exemption
will not result in an unreasonable risk to public health. Any public water systems that receive an
exemption must achieve compliance with the MCL or treatment technique as expeditiously as
practicable, but not later than three (3) years after the applicable compliance date.
The Department did not approve any variances or exemptions during calendar year 2002.
SECTION IV: Summary of Violations
This section identifies the categories of primary drinking water standards and summarizes
the public water system violations data included in Appendix A. The identities of the public
water systems in violation are included in Appendix B.
Organic Contaminants
Public water systems were required to conduct water quality monitoring for sixty-two
(62) organic contaminants that are regulated by primary drinking water standards. Four (4) MCL
violations and thirty-two (32) monitoring violations were reported by thirty- four (34) public
water systems.
Inorganic Contaminants
Public water systems were required to conduct water quality monitoring for seventeen
(17) inorganic contaminants that are regulated by primary drinking water standards. Eightyseven (87) MCL violations and ninety (90) monitoring violations were reported by 151 public
water systems.
Radionuclide Contaminants
Public water systems were required to conduct water quality monitoring for six (6)
radionuclide contaminants regulated by primary drinking water standards. A single MCL
violation and monitoring viola tion were reported by two (2) public water systems.

Total Trihalomethanes
Public water systems were required to conduct water quality monitoring for total
trihalomethanes contaminants. Two (2) MCL violations were reported by one (1) public water
system.
Total Coliform Rule
The Total Coliform Rule violations identify the presence of microbiological
contamination in drinking water supplies. Public water systems are required to conduct water
quality monitoring for coliform bacteria as the basis for establishing compliance with the
drinking water bacteriological standard.
A total of 579 bacteriological MCL violations were reported by 453 public water
systems. A total of forty (40) acute MCL violations were reported by thirty-two (32) public
water systems, and 539 non-acute MCL violations were reported by 421 public water systems.
An acute MCL violation indicates that a public water system detected fecal coliform or E.
coli bacteria in their drinking water supply. A non-acute MCL violation indicates that a public
water system only detected total coliform bacteria in their drinking water supply.
There were also 922 significant monitoring and/or reporting violations reported by 622
public water systems. These violations were issued for failure to conduct the required
bacteriological monitoring or required follow-up monitoring of their water systems or for not
reporting analytical results to the Department.
Surface Water Treatment Rule
The Surface Water Treatment Rule establishes treatment techniques and performance
standards for public water systems that use surface water as a drinking water source. These
treatment techniques and performance standards are used instead of MCL’s for microbiological
contaminants that may be found in surface waters including Giardia lambia, Cryptosporidium
parvum, Legionella, heterotrophic plate count, and viruses.
Public water systems that use surface water are required to provide multi-barrier
treatment to protect against adverse health effects from microbiological contaminants. All multibarrier treatment systems must include the use of a filtration technology approved by the
Department. Public water systems may be approved by the Department to use surface water
without providing filtration under certain conditions and requirements. A water system that fails
to meet these conditions and requirements is reported as a “failure to filter” violation.
For public water systems with approved filtration treatment, twenty-eight (28) public
water systems reported a total of eighty- nine (89) treatment technique violations, and one (1)
public water system reported two (2) significant monitoring violations.

For public water systems with approval to use surface water without filtration, five (5)
public water systems reported a total of five (5) failure to filter violations, and two (2) public
water systems reported one (1) significant monitoring violation each.
A monitoring violation is considered significant under the Surface Water Treatment Rule
when fewer than ten percent (10%) of the required water samples are taken or the water quality
monitoring results are not reported during the required reporting interval.
SECTION V: Conclusions
Overall, public water systems in California delivered drinking water that generally met
all of the established state and federal drinking water standards and was safe to drink. A detailed
breakdown of the violations and their health effect significance for each contaminant category is
provided below.
Organic Contaminants
Violations of drinking water standards for organic contaminants by public water systems
affected approximately 101 people in California (99.99% total compliance). Additionally, ten
(10) public water systems that serve drinking water to approximately 618 people failed to
conduct all of the required water quality monitoring and reporting for organic contaminants. The
specific violations are as follows:
Methyl-tertiary-butyl-ether (MTBE) monitoring violations were reported by five (5)
public water systems that serve approximately 488 people. The failure to complete the required
contaminant monitoring prevented these public water systems from demonstrating compliance
with the adopted drinking water standard.
A single public water system serving approximately 90 people, incurred a single
monitoring violation for each of the following twenty-five (25) organic contaminants: 1,2,4trichlorobenzene, Cis-1, 2-dichlroethylene, 1, 3-dichloropropene, trichlorofluoromethane,
dichloromethane, xylene, 1, 2-dichlorobenzene, 1, 4-dichlorobenzene, vinyl chloride, 1, 1dichloroethylene, 1, 1-dichloroethane, trans-1, 2-dichloroethylene, 1, 2-dichloroethane, 1, 1, 1trichloroethane, carbon tetrachloride, 1, 2-dichloropropane, trichloroethylene, 1, 1, 2trichloroethane, tetrachloroethylene, 1, 1, 2, 2-tetrachloroethane, monochlorobenzene, benzene,
toluene, styrene, and ethylbenzene. The failure to complete the required contaminant monitoring
prevented this public water system from demonstrating compliance with the adopted drinking
water standards.
Dibromochloropropane MCL violations (greater than 0.0002 mg/l) were reported by
three (3) public water systems that serve approximately 101 people. The consumption of
drinking water with levels of dibromochloropropane exceeding the MCL over a long timeframe
could increase the risk of cancer in humans.

One (1) public water system that serves approximately forty (40) people was cited for a
dibromochloropropane monitoring violation. The failure to complete the required contaminant
monitoring prevented this public water system from demonstrating compliance with the adopted
drinking water standard.
Inorganic Contaminants
Violations of drinking water standards for inorganic contaminants by public water
systems affected approximately 106,826 people in California (99.67% total compliance).
Additionally, seventy-five (75) public water systems that serve approximately 137,446 people
failed to conduct all of the required water quality monitoring and reporting for inorganic
contaminants. The specific violations are as follows:
Aluminum monitoring violations were reported by two (2) public water systems that
serve approximately 115 people. The failure to complete the required contaminant monitoring
prevented these public water systems from demonstrating compliance with the adopted drinking
water standard.
Arsenic MCL violations (greater than 0.05 mg/l) were reported by four (4) public water
systems that serve approximately 499 people and a single record keeping violation was reported
by one (1) public water system that serves approximately 625 people. Consuming drinking
water with levels of arsenic exceeding the MCL over a long timeframe, could increase the risk of
cancer or damage to the skin or circulatory system in humans.
A single barium MCL violation (greater than 1 mg/l) was reported by one (1) public
water system that serves approximately 431 people. Consuming drinking water with levels of
barium exceeding the MCL over a long timeframe, could increase the risk of damage to the heart
and cardiovascular system and increase blood pressure in humans.
A single chromium MCL violation (greater than 0.05 mg/l) was reported by one (1)
public water system that serves approximately twenty- five (25) people. Consuming drinking
water with levels of chromium exceeding the MCL over a long timeframe, could increase the
risk of damage to the kidneys, nervous system, or the circulatory system in humans.
A single fluoride MCL violation (greater than 2 mg/l) was reported by one (1) public
water system that serves approximately 453 people and a single record keeping violation was
reported by one (1) public water system that serves approximately 170 people. Consuming
drinking water with levels of fluoride exceeding the MCL over a long timeframe, could increase
the risk of bone disease or mottled teeth in humans.
Nitrate plus nitrite (sum as nitrogen) MCL violations (greater than 10.0 mg/l) were
reported by five (5) public water systems that serve approximately 20,745 people and nitrate plus
nitrite monitoring violations were reported by fourteen (14) public water systems that serve
approximately 1,942 people. Consuming drinking water with levels of nitrate plus nitrite
exceeding the MCL can cause serious illness and possible death in infants that are less than six
(6) months of age.

Nitrate (NO3 ) MCL violations (greater than 45.0 mg/l) were reported by fifty- four (54)
public water systems that serve approximately 84,673 people and nitrate monitoring violations
were reported by fifty-six (56) public water systems that serve approximately 134,504 people.
Consuming drinking water with levels of nitrate exceeding the MCL can cause serious illness
and possible death in infants that are less than six (6) months of age.
A single public water system serving approximately ninety (90) people was responsible
for monitoring violations for arsenic, barium, cadmium, fluoride, mercury, nickel, nitrite,
selenium, antimony, beryllium, and thallium. This public water system was also responsible for
the twenty- five (25) organic contaminant monitoring violations identified on the previous page.
The failure to complete the required contaminant monitoring prevented this public water system
from demonstrating compliance with the adopted drinking water standards.
Radionuclides
Violations of drinking water standards for radionuclide contaminants by public water
systems affected approximately 543 people in California. The specific violations are as follows:
A single combined radium-226 + radium-228 MCL violation (greater than 5 pCi/l) was
reported by one (1) public water system that serves approximately 453 people. Consuming
drinking water with levels of combined Radium-226 + Radium 228 exceeding the MCL over a
long timeframe, could increase the risk of cancer in humans.
A single gross alpha monitoring violation was reported by one (1) public water system
that serves approximately ninety (90) people. The failure to complete the required contaminant
monitoring prevented this public water system from demonstrating compliance with the adopted
drinking water standards.
Total Trihalomethanes
Violations of drinking water standards for total trihalomethane contaminants by public
water systems affected approximately 16,800 people in California (99.95% total compliance).
The specific violations are as follows:
A single total trihalomethanes MCL violation (greater than 0.1 mg/l) was reported by one
(1) public water system that serves approximately 16,800 people. Consuming drinking water
with levels of total trihalomethanes exceeding the MCL over a long timeframe, could increase
the risk of liver, kidney, or central nervous system problems or increase the risk of cancer in
humans.
Total Coliform Rule
Violations of bacteriological drinking water standards by public water systems affected
approximately 871,832 people in California (97.29% total compliance). The specific violations
are as follows:

Acute bacteriological MCL violations were reported by thirty-two (32) public water
systems that serve approximately 5,001 people. Twenty-five (25) public water systems reported
a single acute bacteriological MCL violation, which indicates that the circumstances causing the
violations were corrected immediately.
Six (6) public water systems reported two (2) single consecutive bacteriological MCL
violations, and one (1) public water system reported three (3) single consecutive bacteriological
MCL violations. These violations indicate that the affected population was briefly exposed to a
significant public health risk due to bacteriological contamination of their drinking water
supplies.
Non-acute bacteriological MCL violations were reported by 421 public water systems
that serve approximately 866,831 people. Typically, these non-acute bacteriological violations
are the result of improper water sampling and/or inadequate cleaning of water distribution
system pipelines.
Bacteriological monitoring violations were reported by 622 public water systems that
serve approximately 140,375 people. The failure to complete the required bacteriological
monitoring prevented these public water systems from demonstrating compliance with the
primary drinking water standards for bacteriological quality.
Surface Water Treatment Rule
Approximately 99.98% of California’s population served by public water systems that
use surface water received drinking water that continuously satisfied the filtration treatment and
monitoring provisions of the Surface Water Treatment Rule. The specific violations are as
follows:
For public water systems with approved filtration treatment, twenty-eight (28) public
water systems reporting treatment technique violations serve approximately 2,943 people.
Fifteen (15) of these twenty-eight (28) public water systems reported the violation for only one
(1) month, two (2) public water systems reported the violation for two (2) months, three (3)
public water systems reported the violation for three (3) months, two (2) public water systems
reported the violation for four (4) months, one (1) public water system reported the violation for
five (5) months, one (1) public water system reported the violation for six (6) months, one (1)
public water system reported the violation for seven (7) months, one (1) public water system
reported the violation for eleven (11) months, and two (2) public water systems reported the
violation for twelve (12) months. A single public water system reporting significant monitoring
violations serves approximately 150 people.
For public water systems with approval to use surface water without filtration, five (5)
public water systems reporting failure to filter violations serve approximately 1,659 people and
two (2) public water systems reporting significant monitoring violations serve approximately 970
people.

The Surface Water Treatment Rule treatment technique violations are typically reported
due to elevated turbidity levels in the water or a failure to maintain the required level of
disinfection. High turbidity levels or inadequate disinfection are indicators of potential
breakthrough of cryptosporidium, giardia, bacteria, or viruses in the treatment process which
could create a public health risk.
Enforcement Activities
In response to the violations identified in this report, the Department issued a total of
2,382 enforcement letters, 389 citations, and 27 compliance orders to the affected public water
systems. This aggressive enforcement action is a key element of the Department’s overall
regulatory strategy to bring all public water systems into full compliance with all of the drinking
water standards and regulations and ensure that all Californians receive safe drinking water.
