Dear Hearing Chair Doduc and Hearing Officer Marcus:
On February 23, 2016, the Department of Water Resources and United States Department of
Interior, Bureau of Reclamation ("Petitioners") requested, among other things, an extension of
time, to extend, by 30 days, their deadline to submit written testimony for their cases in chief.
Contra Costa County and Contra Costa County Water Agency neither support nor oppose the
requested extension. Since you granted the requested 30-day extension, we request that you
extend, and it is only fair to extend, by the same amount of time, all other deadlines for this
hearing, including the current March 15, 2016 deadline for "procedural/evidentiary objections
concerning petitioners' cases in chief," the current March 15, 2016 deadline for "receipt of
proposed groupings and order of parties cross-examination," and all deadlines related to Part 1b
of the hearing (See Revised Hearing Schedule, Feb. 11, 2016 Pre-Hearing Conference Ruling, p.
2.) Extending these other deadlines will preserve the staggered hearing schedule in the February
11, 2016 Pre-Hearing Conference Ruling.
Further, Contra Costa County and Contra Costa County Water Agency join in the arguments
made in Mr. Herrick's February 23, 2016letter regarding, "State Water Contractors Request for
Reconsideration."
