Fu unding Opportu O nities th hrough Supplem S mental E Environm mental P Projects On 3 February 2009 9, the State Wa ater Resources s Control Board d (State Water Board) adopted the Supplem mental Environm mental Projects s ow a discharge er to satisfy parrt of a monetary y assessment iimposed in an administrative civil liability (A ACL) order by (SEPs) Policy to allo pleting or fundin ng one or more e SEPs. This fa act sheet addre esses two apprroaches for fun nding opportunities from SEPs that are comp availa able within the Central Valley Region: Central Valley Water Board’s admiinistered SEPss and Rose Fou undation for Co ommunities and d the Environment (Ro ose Foundation n), a third party y administrator for the Centra l Valley Water Board. The Centra al Valley Wa ater Board’s s Suppleme ental Enviro onmental Projects SEP Ps Categorie es: SEPss are projects th hat enhance th he beneficial us ses of the waters of the state, provide a benefit to the public at large and that, at the timess they are includ ded in the reso olution of an AC CL action, are not n otherwise rrequired of the discharger. Th here are two w ways that SEPs are fa acilitated: 1 1. 2 2. SEPs perfo ormed by the discharger; d and SEPs perfo ormed by third--parties paid by y the discharge er (e.g. Rose F oundation or o other party). Allow wable Proje ects: All SE EPs approved by b the Central Valley Water Board B must, at a minimum, sa atisfy the SEP P Policy’s genera al qualification criteria. The SEP shall directly benefitt or study groun ndwater or surfface water qua ality or quantity,, and the benefficial uses of w water of the Sta ate. Examples includ de but are not limited to: monitoring programs; studies or investigations i (e.g., ( pollutant impact characterization, pollu utant source id dentification, etcc.); water or so oil treatment; habitat resttoration or enhancement; pollution prrevention or red duction; wetland, sttream, or other waterbody pro otection, restora ation or creatio on; conservatio on easements; stream aug gmentation; reclamation n; water asse essment (e.g., citizen c monitoriing, coordinatio on and facilitatiion); watershed management facilitation f serv vices; compliance e training, compliance educattion, and the de evelopment of educational ma aterials; enforcement projects, suc ch as training for f environmental compliance e and enforcem ment personnel;; and non-point source s program m implementatio on. Applicant Eligib bility: Any p public or private e entity may su ubmit a proposa al to the State Water W Board o or to a Regional Water Board for SEP funds.. The SEP Policyy allows up to 50% 5 of a settle ement to be use ed towards a SEP. S Ultimatelyy, it is up to the e respective disscharger wheth her to enter into o a setttlement agreem ment that includ des a SEP, and d which SEP to o fund. Project Coverag ge: The S SEP Policy des scribes the nexus of the SEP to be between the nature or llocation of the violation(s) and d the nature an nd location of the prroposed SEP. The projec ct must be desig gned to benefitt groundwater or o surface wate er quality and b be within the bo oundaries of th he Central Valley Reg gional Water Qu uality Control Board. B The projec ct must be tailorred to benefit disadvantaged d communities (D DACs). Locally-based projeccts that not onlyy benefit DACs s, but actively y involve DACs s in project activities and imprrove public hea alth are encourraged. Project Coverag ge: Rose Foundation follows the SEP Policy’s projec ct coverage. While W the goal iss to support pro ojects with a close geographic nexus to the violation(s), projects s in the same overall o watershe ed as where th he violation(s) o occurred may b be eligible.
