A. INTRODUCTION
1. This report is a supplement (“Supplemental Report”) to the Proposal Trustee’s Second
Report filed with the Court on July 24, 2014 and should be read in conjunction therewith.
2. The purpose of this Supplemental Report is to provide this Court with an update on the
status of the Company’s efforts to obtain landlords’ and counterparties’ Consents to the
assignment of the Real Property Leases and the Assumed Contracts the Purchaser wishes to
have assigned to it.
B. STATUS OF CONSENTS FOR THE ASSIGNMENT OF CONTRACTS
3. Since the filing of the Second Report, the Proposal Trustee advises that an additional 9
parties have been contacted by telephone and a further 39 Consents have been received.
4. Accordingly, as of 8:45 a.m. EDT on July 30, 2014, the Proposal Trustee advises the Court
that:
a. Of the 148 landlords where consent to the assignment is required:
i. 144 have been contacted directly by telephone, of which:
1. 109 are deemed critical pursuant to the 894 APA;
2. 35 are deemed not critical pursuant to the 894 APA.
ii. 4 have not yet been contacted directly by telephone1 despite efforts to do so
by the Proposal Trustee and the Company’s legal counsel, of which:
1. 2 are deemed critical pursuant to the 894 APA;
2. 2 are deemed not critical pursuant to the 894 APA.
b. All 8 of the counterparties to the Assumed Contracts that require consent to the
assignment have been contacted directly, of which:
i. 7 are deemed critical pursuant to the 894 APA;
The Proposal Trustee notes that these parties have been served all materials filed in these proceedings by
email, fax or by rush courier.

ii. 1 is deemed not critical pursuant to the 894 APA.
5. With respect to the status of the Consents, the Proposal Trustee advises the following:
a. Of the 148 landlords where consent to the assignment is required:
i. 110 have provided their consent, of which:
1. 81 are deemed critical pursuant to the 894 APA; and
2. 29 are deemed not critical pursuant to the 894 APA.
ii. 38 have not provided their consent, of which
1. 30 are deemed critical pursuant to the 894 APA; and
2. 8 are deemed not critical pursuant to the 894 APA.
b. Of the 8 counterparties to the Assumed Contracts where consent to the assignment is
required:
i. 4 have provided their consent and all 4 are deemed critical2;
ii. 4 have not provided their consent, of which
1. 3 are deemed critical pursuant to the 894 APA; and
2. 1 is deemed not critical pursuant to the 894 APA.
Of the 4 counterparty consents received, 2 relate to contracts in respect of Moneris. Moneris and the
Purchaser have entered into new agreements. In light of these new agreements, the Purchaser has agreed
to waive the condition that the consent of Moneris to the assignment is critical; however, for purposes of
maintaining consistently in tracking Consents, we have categorized the new Moneris/Purchaser contracts
as “consents received”. We anticipate Moneris and the Purchaser will execute a new agreement with
respect to the one remaining critical Moneris contract; however, this new contract will likely not be
finalized prior to the hearing.
