COUNTRY PAPER ON FACILITATION OF INTERNATIONAL ROAD TRANSPORT Legal Advisor Ministry of Transport Malaysia CURRENT LEGAL ARRAGEMENTS FOR INTERNATIONAL ROAD TRANSPORT & ITS IMPLEMENTATION • ASEAN Framework Agreement on the Facilitation of Goods in Transit [AFAFGIT] • Signed on 16 December 1998 • There are 9 Protocols under the AFAFGIT Malaysia has signed and ratified 4 Protocols under AFAFGIT Continue… •Besides AFAFGIT, Malaysia also had signed ASEAN Framework Agreement on the Facilitation of Inter-State Transport [AFAFIST] on 10th December 2009. •However, this Agreement can only be ratified once all the Protocols under AFAFGIT has been signed and ratified. Continue… • Malaysia also had signed ASEAN Framework Agreement on the Multimodal Transport [AFAMT] on 17th November 2005. • Malaysia is in the process of drafting new act known as Multimodal Act for the implementation of AFAMT and several consultations with stakeholders has been done. • Currently, Malaysia had signed the MOU known as MOU Malaysia and Thailand - The Movement In Transit of Perishable Goods By Road From Thailand Through Malaysia To Singapore. • Signed on 23 November 1979. • This MOU will be revoked once AFAFGIT take place. PARTICIPATION ON BIMP-EAGA • Under Brunei, Indonesia, Malaysia, Philippines –East ASEAN Growth Area (BIMP-EAGA), Malaysia is the parties to the following MOUs- Our target/aim: • Enhancing the existing domestic laws to met the requirements provided in the International Regulation on road safety.
