Famiglia e Solidarietà Sociale 5 THE SOCIAL REFORM Law 328/00: Framework Law for the implementation of an integrated system of actions and social services It is the Law reforming the welfare system aiming at providing citizens and families with an integrated system of social services, a better quality of life and equal opportunities in order to prevent, abolish and reduce needs, difficulties and lack of autonomy conditions 6 THE SUBJECTS DEFINED BY LAW 1/4 • GOVERNMENT – it defines the principles and objectives of the social policy through the National Plan on actions and social services –it identifies a minimum standard level for services provided –it states the minimum structural and organizational standard level for setting up services –it defines the professional profiles of people working in the social field –it defines the repartition of the fund coming from Fondo Nazionale Politiche Sociali must be divided 7 THE SUBJECTS DEFINED BY LAW 2/4 • Regions: – Identification of the territories where the law is applied – Planning, coordination of social actions – Monitoring of the implementation of social services and of the integration among the planned interventions, in particular between social and health actions – Definition of the criteria for the authorisation, accreditation and monitoring of structures – Distribution of Resources of the Fondo Nazionale Politiche Sociale (National Fund for Social Policies) to the local areas – Planning and funding the professional training of the personnel engaged 8 THE SUBJECTS DEFINED BY LAW 3/4 • Provinces – They participate in the planning of the integrated system of services according to the rules defined by Regions which defines the roles of Provinces on the following points: •Collection of information on the needs and resources available (supply and demand) •Study on relevant social phenomena •Promotion on training/updating courses •Participation in the definition of Piani di Zona 9 THE SUBJECTS DEFINED BY LAW 4/4 • Municipalities – They are in charge of administrative functions on social actions at local level –Planning and implementation of the system of social services at local level –Supply of services, including economical services –Authorisation, accreditation and monitoring of social services 10 LOMBARDY REGION… • Within the planning system it gives a role also to Aziende Sanitarie Locali for: – Checking the indications provided by the Region –Technical and Planning Support –Promotion of the integration between social services and health services •ASL: on behalf of the Region it is in charge of monitoring and funding according to L.328/00 11 Besides this…. •Lombardy Region has aimed at involving the subjects working in the Third Sector in the planning phase Methods of Programmazione Negoziata 12 How Lombardy Region has adopted Law 328/00 Lombardy Region had to keep in consideration a consolidated system of social services built before of Law328/2000 was in force. This has been the reason why it adopted the Law through “CIRCOLARI AND LINEE DI INDIRIZZO” That defined: •The territories •The model of governance of piani di zona •The role of Asl, of Provinces and of other subjects as volunteers, associations, cooperatives •The objectives, in particular to guarantee in each territory the necessary services and new ways of answering to needs, through social vouchers •The monitoring and checking system of implemented activities, the expenses carried out for social services and the use of money 13 PIANI DI ZONA within Law 328/00 (art. 19) Piani di Zona are the tool to define, plan and implement social services, provided by subjects of the public sector, of the Third sector and of private subjects District is the area considered of the right dimension for an integrated planning and management of services, that is to say for a Piano di Zona Piani di Zona aim to: –develop the actions for the home care of people in difficulties –rationalize and strengthen the existing services 14 PIANI DI ZONA within Law 328/00 •The planning of Piani di Zona must always be done in association •The agreement of the program is the legal tool on which the plan is based •The agreement must be undersigned by all the Municipalities of the District 15 The area in which PIANI DI ZONA are carried out What are districts? Aggregation of several Municipalities: they are aggregation already identified for the organization of health services. The Region has decided that thegroups of Municipalities already organized for running together health services will be the same groups running together the Social Services according to the Piani di Zona. The number of Municipalities changes depending on the population 16 IMPLEMENTATION OF Piani di Zona 2003 : 1° year of the implementation of social planning at local level 1st implementation of Piani di Zona: 2003-2005 December 2005: Elaboration of PIANI DI ZONA the years 2006-2008 At the present the 1st year of the second round of Piani di Zona is being implemented Regione Lombardia – D.G. Famiglia e Solidarietà Sociale 17 “GOVERNANCE” of the PIANO DI ZONA Organisation at institutional level of the Piani di Zona: •Political Body: assembly composed by Mayor of the District • Technical Body: l’ufficio di piano, tool for the coordination , preliminary investigation, management of the implementation of the piano •tavoli tecnici ( analysis and technical planning ) •The subjects of the Third Sector that participate in the planning through the participation in the technical discussions Regione Lombardia – D.G. Famiglia e Solidarietà Sociale The structure of social services system in Lombardy Region • “Unità di offerta”: – Home assistance – Daily cicle and half residential – Residential • Diversification for need area (elderly, disabled, minors and family, poverty and marginalization, immigration, dependence) • Diversification on the base of kind of difficulty and need of answer • “Titoli sociali” (social voucher) – Actions to strengthen of the capabilities of “taking care” of the family and support to the free choice concerning the access to personal services 21 Regione Lombardia – D.G. Famiglia e Solidarietà Sociale “TITOLI SOCIALI” “Titoli sociali” are planned and used for actions of help for home assistance of persons in difficulties, to be carried out supplying: BUONO SOCIALE: Tool for supporting direct or indirect care by relatives or of informal assistance through solidarity networks VOUCHER SOCIALE: Tool for purchasing social personal services by public and private accredited providers 22 Regione Lombardia – D.G. Famiglia e Solidarietà Sociale FUNDING OF SOCIAL AND ASSISTANCE SYSTEM The social and assistance system is financed by the Fondo Nazionale per le Politiche Sociali (National Fund for Social Policies), composed by the fundings for the different sectors, by regional autonomous resources and by municipality resources. It has the following characteristics: Target and functions: -Minors-in difficulties: social and assistance services provided at home level, residential (community and centres of first aid for mothers and children) and within the criminal sector -minors-area of social and educational actions: social and educational activities carried out in day nursery, micro-nursery, “spazi gioco”, centres for young people aggregation, daily recreational centres -elderly: home assistance -disables: home assistance provided at home and insertion and working reinsertion activities -drug addicted and psychiatric patients: insertion and working re-insertion activities -immigrants and emigrated: social, cultural and working integration activities -nomads: actions for social and cultural integration -convicted adult and minors: training and working activities, support activities 23 inside and outside the jail -homeless: first contact activity, hosting and social re-insertion FUNDINGS Fondo Sociale Regionale (Regional Social Fund): composed by regional autonomous resources for social and assistance activities and by resources coming from the regional “leggi di settore”(l. r. 23/99). Fondo Nazionale per le Politiche Sociali (National Fund for Social Policies). Until the year 2000 it was composed only by fundings for the national “Leggi di settore”; since 2001 it has been integrated by a part of the fund for the development of social actions and services ( l. 328/00).
