FORWARD MARKETS COMMISSION, MUMBAI Highlights/ Important Developments for the fortnight from 1.1.2014 to 15.1.2014 • Total value of trading at the Commodity Exchanges during the fortnight, 1st January, 2014 to 15th January, 2014 was ₹ 2,82,002.28 crore. The cumulative value of trade from 1stApril, 2013 upto 15th January, 2014 during the financial year 2013-14 was ₹ 85,28,863.77 crore. The corresponding figures for the previous year were ₹ 6, 89,542.16 crore and ₹ 136, 51,989.78 crore respectively. • The Commission, on 13th January. 2014 conveyed its approval for the addition of a new clause 11.2.1 (l) after the existing clause 11.2.1 (k) to the Bye-laws of the ACE Derivatives and Commodity Exchange Ltd., Mumbai. The additions mainly relate to provisions for sharing of information among Exchanges about default members in the Bye-laws of the Exchange. • The issue of granting exemption from the payment of initial/ additional/special margins for the hedgers to reduce the cost of hedging has been deliberated upon by the Risk Management Group (RMG) in its first meeting held on 18th November, 2013. The RMG has recommended that if a hedger has made early pay in of commodity, then he may be exempted from paying the risk margins. The Commission had earlier issued directives in respect of early pay-in facility in agricultural commodities thereby exempting delivery margins from the market participants who have moved their goods to the Exchange accredited warehouses. Therefore, in partial modification of the said directives, the Commission on 15th January 2014 directed the Exchanges that they may exempt the market participants, who have deposited certified goods against all the relevant futures contracts sold and earmarked for -1- delivery, to the Exchange accredited warehouse, from paying initial, additional and special margins. Such participants will continue to remain exempted from payment of delivery margins. However, the Exchange shall continue to collect mark to market margins from such market participants. These directives are made effective from 1st February, 2014. • The Commission on 9th January, 2014 has appointed Shri R. Mohandas as Independent Director on the Board of India Pepper and Spice Trade Association (IPSTA), Kochi, for a period up to 31/03/2015 under section 6 (2) (b) of the Forward Contracts (Regulation) Act, 1952. • The Commission, on 9th January, 2014 conveyed its approval for the appointment of the following on the Board of ACE Derivatives and Commodity Exchange Limited:a) Mr. Narayan S.A., Mr. Prakash Nayak, Kotak Mahindra Bank/ Kotak Mahindra Prime, Mr. Ashok Yadav, HAFED, Mr. K. Chandrashekhar, Union Bank of India, and Mr. Vineet Dudeja, Bank of Baroda, under Shareholder Directors category on the Board of the Exchange, as per the provision given in Clause 1.2 of the revised Guidelines dated 12th August, 2013. This appointment is for the year 2013-14 (one term) up to the date of Annual General Meeting. b) Ms. Dharmishta Raval as Chairman of the Board, Mr. Dileep Chokshi as Chairman of the Audit Committee and Mr. B. M. Jindel as the Chairman of the Remuneration & Compensation Committee of the Exchange, in terms of the revised Guidelines dated 12th August, 2013 for constitution of Board of Directors, Nomination and role of Independent Directors and appointment of Chief Executives at the Nationwide Multi Commodity Exchanges in India. -2- • The Commission, on 8th January, 2014 conveyed its approval for the appointment of the following on the Board of the Universal Commodity Exchange Limited (UCX), Navi Mumbai:a) Mr. D.S. Ahluwalia, Executive Director (Finance), Rural Electrification Corporation Ltd (REC), New Delhi as Shareholder Director in place of Mr. V.K. Arora on the Board of the Exchange in compliance with the provision given in Clause 1.2 of the revised Guidelines dated 12th August, 2013 for constitution of the Board of Directors, Nomination and Role of Independent Directors and appointment of Chief Executives at the Nationwide Multi Commodity Exchanges. b) The appointment of Mr. G. Chandrashekhar as Independent Director under section 6 (2) (b) of the Forward Contracts (Regulation) Act, 1952 on the Board of the Universal Commodity Exchange Ltd., (UCX), Navi Mumbai for a period up to 31/03/2017 in terms of Clause 1.1 (i) of the Commission’s revised Guidelines dated 12th August, 2013. • The Commission, on 13th January, 2014 has conveyed the approval of the Commission to the Universal Commodity Exchange Limited (UCX), Navi Mumbai regarding the appointment of Mr. Devdas Chhotray, (IAS Retd.), Independent Director as a Chairman of the Board, Mr. A. Ramkrishnan, Independent Director as Chairman of the Audit Committee and Ms. Neela Gangadharan, Independent Director as the Chairman of the Remuneration & Compensation Committee of the Exchange, in terms of the revised Guidelines dated 12th August, 2013 for constitution of Board of Directors, Nomination and role of Independent Directors and appointment of Chief Executives at the Nationwide Multi Commodity Exchanges in India. -3- • The Commission on 1st January, 2014 approved for preponement of the Due Date / Expiry Date of Crude oil January 2014 contract as 17.1.2014 proposed by the UCX, Mumbai. As per the international holidays, the Exchange had revised the Expiry date from 20.1.14 to 17.1.14. • The Commission on 8th January, 2014 approved for modification in conversion factor as 31.9899927 instead of 32.1507425 in Final Settlement Price in respect of Gold hedge contracts proposed by NCDEX. • The Commission on 8th January, 2014 approved to the proposal sent by ACE Ltd., Mumbai regarding preponement of the Due Date/Expiry Date in Crude Oil January 2014 contract. The expiry date was revised by the Exchange from 20.1.14 to 17.1.14 as per international holidays. • The Commission on 13th January, 2014 approved for modification in 1) Moisture and Count in Maize and 2) Revision in Additional Delivery Centre proposed by the NCDEX. • The Commission on 15th January, 2014 requested all the regional exchanges to follow the list of holidays declared under the Negotiable Instruments Act 1881 and the local holidays declared by State /Central Government organizations for Regional/ Commodity Specific Exchange under intimation to the Commission. • The Commission on 15th January, 2014 has approved the Bye-laws and Rules of UCX regarding “sharing of information among Exchanges about default members”. • Development at National Spot Exchange Limited (NSEL): (i)There were two payouts during the quarter under reference, i.e., pay out on 7th January, 2014 (21st pay out) of ₹ 2.45 Crore and pay out on 14th January, 2014 (22nd pay out) of ₹ 3.24 Crore. -4- • The Forward Markets Commission organized the following capacity building programmes for the benefit of various stakeholders.
